All services may be
used for lawful purposes only. Transmission, storage, or presentation
of any information, data or material in violation of any United States
Federal, State or City law is prohibited. This includes, but is not limited
to: copyrighted material, material we judge to be threatening, obscene,
demeaning to others, or material protected by trade secret and other statute.
The subscriber agrees to indemnify and hold us harmless from any claims
resulting from the use of the service which damages the subscriber or
any other party.
Note: Sites that promote any illegal
activity or content that may be damaging to our servers or any other
server on the internet. Links to such materials are also prohibited.
In addition any site selling or
promoting Bulk email services is not allowed

Warez Sites
Distribution points
Irc Bots
Copyrighted Mp3, File Storage Download sites
Subhosting - any domain housing additional users without first clearing it with us.
Any site whose primary purpose is file distribution
Shareware, sound, video, image and multimedia
archives
We will be the sole arbiter as to
what constitutes a violation of this provision.
Traffic
Guidelines
Each account comes with
6 gigabytes of free traffic per month. Additional transfer fee's
are $5 per gig for each gig over 6. We view bandwidth daily, if we see
a pattern of high bandwidth forming we will either cantact you via e-mail or call.
We reserve the right to disable a site that is flat out violating bandwidth usage.
Unlimited Plans
We do not meter the usage of bandwidth of accounts that have unlimited
bandwidth. Does that mean you have free reign of the server your
account is on? No, it does not. Sites that use high resources like cgi, perl, php, mysql, bandwidth etc... may fall under our "High Resource Policy" and then; therefore, would be subject to a verbal warning.
There are certain restrictions that you need to be aware of before you sign
up for an unlimited plan. We created these plans so that your business or
personal website can grow without fear of overrunning your bandwidth or
storage space. This way you can concentrate on more important things. As
long as you don't abuse your privileges as an unlimited customer, we will
not monitor your usage. Here are our guidelines, which are just plain
common sense.
There are certain content that we do not allow on unlimited plans. This
includes:
File Storage sites
Resold websites
Sub Hosting
Mailing lists
Chat Rooms
Banner rotation
MP3, AVI, MPEG storage, archiving
Image galleries that take over 20% total space
ZIP file archives, or other program/file distribution
Your unlimited site is for HTML and all of the images and other content for
your site only. You may not link to images, files, or other content from
any other websites. We do not allow any content that violates our policies.
If you are not sure if your site would be benefited by one of our unlimited
plans, then please contact us to discuss your needs. If you do need to run
a storage site or other type of archive site mentioned above, please contact
us about our metered plans so we can help you assess your needs.
High Resource Sites
Any site that is deemed as impairing the performance of our servers either by high disk utilization, high bandwidth usage, or high CPU usage will be entered into our "High Resource Customer" program. High Resource sites are sites that use an excessive amount of system resources such as bandwidth, Storage or CPU utilization. Downloadable copyrighted software is prohibited on the servers. Sites
that specialize in the distribution of images, software, and software addons are not allowed. It is at Webhosting Webdesigns Inc.'s sole discretion to decide which sites are "High Resource" sites. Sites who have been deemed as a "High Resource" site will be subject to the following:
- Verbal or email warning.
- Deactivation of account if action is not taken in ample amount of time.
- Bandwidth charges of $5.00 per gig over the set amount allowed per account.
Pornography
Note: Pornography and sex-related merchandising
are prohibited on all servers. This includes sites that may infer sexual
content, or link to adult content elsewhere. This is also true for sites
that promote any illegal activity or content that may be damaging to our
servers or any other server on the internet. Links to such materials are
also prohibited. Pornography that we prohibit, is nudity, and nude
sexually explicit anime. Partial nudity as art is considered acceptable. If
you have a site that is questionable please call us as we will have a look
at it and let you know.
MP3's
We do not allow copyrighted MP3 music for download or archive.
You are allowed to have your own MP3's. An example would be a band that would like to promote the music on thier website, or
a home recording of something.
Chat Rooms
We do not allow clients to install their own chat
rooms that are CGI based. These tend to be large system hogs and we cannot allow it as an account
option. You are allowed to have JAVA chatrooms.
Domain Registration
Webhosting Webdesigns offers domain registration at Domaintechs. Domain registration is non-refundable as once we register it we cant take the domain name back. Make sure you spell the domain correctly on the sign up form, if you detect an error contact us immediately
Server
Updates
Webhosting Webdesigns reserves the right to
updates its servers at anytime. As a result we can not be held responsible to anything that may result
in a persons site(s) not working properly due to the changes or updates on the server.
Server
Abuse
Any attempts to undermine
or cause harm to a server is strictly prohibited.
Commercial
Advertising - Email
Our servers may not
be the source, intermediary, or destination address involved in the transmission
of spam, flames, or mail bombs. Your domain may not be referenced as originator,
intermediary, or reply-to address in any of the above. Advertising sites
on other servers which in turn contain links to a domain on our servers
is prohibited. We consider spam any mass unsolicited message in the mediums
of Newsgroups and Email. If you are found to have spammed, then we will
immediately, without warning, disable your domain. In addition, we will
impose a $100 penalty for each spam policy violation. We reserve the right
to refuse or cancel service to known spammers. Lastly, we reserve the
right to determine what violates this policy.
As such, any violation will result
in immediate deactivation of services without refund.
Payment
Policies
All accounts are set up within 1 business day upon receipt of full payment.
Payment is due each anniversary period 5 days prior to end of previous term.
Cancellations must be made in advance, failure to notify us before the 5 day
limit set on renewals will result in the following month not being refunded.
The customer is responsible for all money owed on the account from the time
it was established to the time it is terminated. Requests for terminations
must be submitted in writing to Webhosting Webdesigns Inc. or using the on-line
cancellation form. A faxed memo is also accepted in most cases and should
have all the account information on it before it is considered cancelled.
For Credit Card Orders Credit card orders will be set up within 24 hrs.
Accounts will be automatically billed according to the term selected on the signup form, to
the card number on file unless notified otherwise. Each account will be
billed 5 days prior to end of each term. E-Mail notification will be sent
only if requested at the time of billing. All credit card payments will be
billed on the date due, the email notification is solely a courtesy email.
In the event the credit card does not clear with the bank, the customer
will be notified by email. Past due accounts that are not brought current
within 5 business days of the email notice are subject to suspension and
possible account termination. Chargebacks or denying credit card charges
will be subjected to the amount owed on current and past invoices that went
unpaid and a fee of $25 will be added to each chargeback request. Failure
to pay this will result in your account being turned over to a collections
agency for payment.
For Check or Money Order Orders- Check or money order orders will be set up within 1 business day upon receipt of payment. E-Mail notification will be sent 10 days prior to payment due date. Checks returned unpaid (NSF) will be billed a $25.00 service charge. Past due accounts that are not brought current within 10 days of the email notice are subject to suspension and possible account termination.
Chargebacks and Checks returned for NSF- Checks returned for NSF will incur a $25 charge to the affected account, and the site associated with it will be disabled until payment is resolved. Credit card chargebacks will also result in a $25 charge, and the site for which payment is due will be disabled until resolution of payment. If you do not understand the charge on your credit card, we urge you to call us first, not your credit card company.

Refusal
of Service
Webhosting Webdesigns reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by Webhosting Webdesigns if Webhosting Webdesigns institutes its right of cancellation. If cancellation is caused by customers violation of these policies, then no refund will be disbursed.
Customers can cancel service any time and be refunded any amount exceeding the pre-payment of
the current month. Due to security concerns, all account cancellations must be done in writing via US mail or fax with a
valid signature of the primary contact of the account, account name, reason for cancellation, and last 4 digits of credit card
on file. You may also use the Account Closure form. If payment was made by
check or bank transfer, the zip/postal code of the primary contact must also be
included. Payment will be made by company check within 30 days of receipt of cancellation or credit card return.
The account will be closed within 24 hours of the closure request.
Indemnification
Customer agrees that
it shall defend, indemnify, save and hold amhosting.com harmless from any and all
demands, liabilities, losses, costs and claims, including reasonable attorney's
fees asserted against amhosting.com, its agents, its customers, officers and employees,
that may arise or result from any service provided or performed or agreed
to be performed or any product sold by customer, it's agents, employees
or assigns. Customer agrees to defend, indemnify and hold harmless amhosting.com
against liabilities arising out of; (1) any injury to person or property
caused by any products sold or otherwise distributed in connection with
amhosting.com server; (2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party and (3) copyright
infringement.
Disclaimer
Webhosting Webdesigns will not be responsible for any damages your business may suffer. From such acts of war,
fire, earthquakes, terrorism, acts of god, floods, vandalism, network outages not cause by Webhosting
Webdesigns, viruses, hacking, mechanical failure, loss of power, and loss of data due to uncontrolled
reasons. Webhosting Webdesigns disclaims any warranty or merchantability or fitness for particular purpose.
This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all
service interruptions caused by Webhosting Webdesigns and its employees. Webhosting Webdesigns makes no warranties of
any kind, expressed or implied for services we provide. Webhosting Webdesigns reserves the right to revise its
policies at any time without prior notification.
